DMCA Copyright Policy

This policy is provided by HES Technology, LLC ("Company", "we", "us", or "our"), a company organized and existing under the laws of the State of Delaware, with its principal office located at 1111B S Governors Ave STE 29280 Dover, DE, 19904 US.

HES Technology, LLC respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws, we will respond expeditiously to notices of alleged copyright infringement.

1. Notification of Copyright Infringement

If you are a copyright owner or an authorized agent thereof and believe that any content hosted on the Service (including Web repositories, Studio projects, or content generated by Social Media bots) infringes upon your copyrights, please submit a written notification to our Designated Copyright Agent pursuant to the DMCA.

Your notification must include the following information (please ensure it is complete):

  • Authorized Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Description of Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site (e.g., manga title, volume number, ISBN, or original publication link).
  • Location of Infringing Material:Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. (This is crucial; please provide specific URLs, such as https://loomic.io/view/12345 or links to Twitter replies, to allow us to precisely locate and remove the content).
  • Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address.
  • Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Takedown Procedures and Response

Upon receipt of a valid notification that complies with the DMCA requirements, we will take the following actions:

  • Immediate Removal or Disabling of Access:We will remove or disable access to the material claimed to be infringing (e.g., invalidating the specific manga link or deleting the Twitter reply).
  • User Notification: We will take reasonable steps to notify the user who uploaded the material that it has been removed or disabled and explain the reason for such action. We will also provide them with the opportunity to file a Counter-Notice.

4. Repeat Infringer Policy

The Company adopts a strict "Repeat Infringer Policy." In appropriate circumstances and at our sole discretion, we will:

  • Terminate Accounts: Unconditionally terminate the accounts of users determined to be repeat infringers (e.g., accounts that have been the subject of 3 valid DMCA complaints).
  • Delete Data: Permanently delete all data stored on our servers associated with such users.
  • Ban Re-registration: Prohibit such users from re-registering for the Service.

5. Counter-Notification Procedures

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a written Counter-Notification to our Copyright Agent. To be effective, your Counter-Notification must include the following:

  • Your Signature: Your physical or electronic signature.
  • Identification of Material: Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed or disabled.
  • Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Consent to Jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the District of Delaware (or, if your address is outside of the United States, for any judicial district in which the Company may be found), and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.

Note: Upon receipt of a valid Counter-Notification, we may restore the removed material or cease disabling access to it in 10 to 14 business days, unless the original complaining party notifies us that they have filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on our Service.

6. Liability for Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages (including costs and attorneys' fees) incurred by us or the alleged infringer. If you are unsure whether the material you are reporting is in fact infringing, we strongly suggest that you consult with an attorney before filing a notification.
